Award-winning Texas attorney Jason Stephens of Stephens Law recently obtained a $15.68 million verdict — the largest personal injury verdict in Grayson County history — on behalf of the family of a plumber who was fatally electrocuted on the job.
Jason represented the family of Kiley Russell, who was killed when a flagpole he was attempting to move touched an overhead electric powerline. Mr. Russell and his coworkers were in the process of replacing a water main at the River Ranch apartment complex in Sherman, which was operated and managed by defendant Monticello Asset Management Inc. The incident killed Mr. Russell and severely injured his two coworkers.
Monticello Asset Management Inc. argued that the workers and their employer were liable for the accident, even though Monticello had installed the flagpole. Attorney Stephens presented evidence demonstrating that Monticello had relocated the flagpole as part of a remodel project and had created a dangerous condition by installing the flagpole next to the water main and next to the overhead powerline, and the jury assigned 50% of the fault to Monticello.
The week-long trial was argued before the Honorable Larry Phillips in the 59th District Court in Sherman, TX. Jury deliberations lasted a full day before the jury returned the historic verdict against Monticello Asset Management Inc.
The compensation awarded included $10.5 million for Mr. Russell’s widow and two minor children due to their mental anguish and past and future loss of companionship. Represented by different counsel, Mr. Russell’s two injured coworkers were awarded $5.1 million.
According to Jason Stephens, “juries don’t like it when companies take shortcuts and put profits over safety, which is exactly what we saw in this case.” He continued, “as a result, two little boys lost their daddy, and their mom lost the love of her life. Hopefully, this verdict will help ensure that Kiley is remembered in the hearts of all those who knew him and whose lives he touched.”
